Agreement

By using the WalkNYC mobile application or this website, you agree to the following terms and conditions. "You" refers to you, the person accessing this app or website. "The Company", "We", and "Us" refer to Joe Puccio.

Exclusions and Limitations

WalkNYC and its associated content are provided on an "as is" basis. To the fullest extent permitted by law, the Company:

Excludes all representations and warranties relating to the app, this website, and their contents, including in relation to any inaccuracies or omissions in mapping data, street coverage, leaderboard rankings, or other content.
Excludes all liability for damages arising out of or in connection with your use of the app or website. This includes, without limitation, direct loss, loss of business or profits, damage caused to your device, and any other direct or indirect, consequential, or incidental damages.
Does not warrant that any route, street, or location displayed in the app is safe, legal to access, or accurate. You are solely responsible for your own safety and decisions while walking.

The above exclusions and limitations apply only to the extent permitted by law. None of your statutory rights as a consumer are affected.

Access and Interference

You agree that you will not use any robot, spider, scraper, or other automated means to access the WalkNYC app or its backing services without prior written permission. Additionally, you agree that you will not:

Impose an unreasonable or disproportionately large load on our infrastructure.
Submit fabricated, falsified, or otherwise dishonest leaderboard data.
Reverse engineer, decompile, or attempt to extract the source code of the app, except to the extent permitted by applicable law.
Interfere with the proper working of the app or any of its services.
Bypass measures used to prevent or restrict access.

Availability

Redistribution or republication of any part of the app or this site is prohibited without express written consent. The Company does not warrant that the service will be uninterrupted, timely, or error free. By using this service you indemnify the Company and its agents against any loss or damage arising from your use of the app.

Log Files

Our servers automatically log standard request information (IP address, request path, timestamp, user-agent) for systems administration and troubleshooting purposes. IP addresses are not linked to personally identifiable information.

Leaderboard and Display Names

You may set a display name and neighborhood that appear on the public leaderboard inside the app. You are responsible for the content you choose. Do not include personal information about yourself or others, offensive language, or content that infringes any third party's rights. We may remove any display name or neighborhood at our discretion.

Copyright

Copyright and other intellectual property rights exist on all software, design, text, and other content provided through the WalkNYC app and this website.

Waiver

Failure of either party to insist upon strict performance of any provision shall not constitute a waiver thereof. No waiver of any provision shall be effective unless expressly stated and signed by both parties.

General

The laws of the State of New York govern these terms. By using the app or this website you consent to the exclusive jurisdiction of the New York courts. If any term is deemed invalid, the remaining terms will continue to apply.

Changes

The Company reserves the right to modify these Terms of Use at any time. Continued use of the app or website constitutes acceptance of the updated terms.
